MySpace Settles on Spam
Social networking company gets $2.55 million in cash from The Globe.com.

MySpace on Thursday said it settled a lawsuit against The Globe.com, one year after the popular social networking site sued the advertising and gaming company for sending spam to its members.
The social networking site did not provide terms, but a regulatory filing by The Globe.com earlier this month said the settlement was worth $2.55 million.
MySpace claimed that Fort Lauderdale, Florida-based The Globe.com sent almost 400,000 unsolicited email messages to MySpace users from 95 or more dummy accounts. The lawsuit, filed last June, accused The Globe.com of violating the California Business and Professions Code and the federal CAN-SPAM Act.
The 2003 CAN-SPAM Act limits the types of emails that companies are allowed to send, defines penalties for violating the law, and offers protection for consumers. It is the same law that so-called "Spam King" Robert Alan Soloway was accused of violating by a federal grand jury in Seattle yesterday.
U.S. District Judge R. Gary Klausner in February found The Globe.com liable for violating both the federal law and the state code, according to an SEC document filed that month by The Globe.com.
That company's most recent quarterly report estimated it could have been liable for as much as $120 million in penalties under the CAN-SPAM Act alone. But the parties settled in March of this year and on April 18, The Globe.com forked over just $2.55 million in cash.
MySpace and The Globe.com were not immediately available for comment. MySpace may have agreed to the small amount because The Globe.com could be headed for bankruptcy. The gaming company's recent report indicates that without additional capital, "management does not believe that the Company [sic] will be able to fund its operations beyond May 2007."
The Globe.com suit is one of several over the past couple of years brought by MySpace against spammers and phishers, who try to get passwords and other personal information via email and the web. MySpace has sued both individual and corporate spammers.
